The Former President's Framework of Consequences and Incentives

The ex-president's voracious urge for payback has swiftly transformed into a structured framework. During the past year, the president's anger and impulses have taken on the shape of official policies in a manner reminiscent to earlier dictatorial regimes. Justice department personnel who fail to comply are promptly dismissed and replaced by devotees. Critical leaders who confront him risk prosecution, court proceedings and sanctions. Adversaries have been categorized under administration directives as “anti-American”, “against faith communities” and “against free markets”, and menaced with legal action as “extremists”.

Government Institutions Transformed

All case involving prosecution of political opponents and leniency for supporters displays its own unique qualities. But, regardless of their particular nature, they embody expressions of what has developed as a systematic method. Such events are far from isolated. The administration's cleansing of federal attorneys and FBI personnel, alongside his installation of supporters in key posts, started quickly, soon took on a consistency, and has now been molded into a structure. DoJ and the law enforcement agency have been restructured into ideological organizations under his clear orders to implement his demands. Unfairness has been turned into routine. It represents the system of punishment.

Leadership is preoccupied with targeting the President's perceived enemies than they are with safeguarding our country's safety.

Internal the Apparatus

The foundation of this framework has been revealed in the lawsuit of several previous top FBI agents lodged in late summer in the federal court in the capital against agency head Kash Patel and attorney general a key figure for illegal termination in “a campaign of retribution against Plaintiffs for what Defendants deemed to be a failure to exhibit sufficient allegiance”. In the complaint that Brian Driscoll, the previous acting FBI director, recounts a conversation in which the director “publicly acknowledged the illegality of his conduct”.

Driscoll had attempted to defend FBI agents from being dismissed, the filing states. Patel advised him that “administration officials” – understood by him to be the presidential administration and federal prosecutors – had instructed him to fire all those who they determined as having worked on a legal probe against the president. The document adds: “The director clarified that he had to fire the individuals his leaders told him to dismiss, because his ability to keep his own position was contingent on the ouster of the agents who handled investigations involving the leader. He explained that there was nothing he or Driscoll could do to stop these or any other dismissals, because ‘the agency attempted to put the chief in prison and he recalls it clearly.’” When he advised him he was breaking the bureau's own regulations, he supposedly said “he knew that and he realized the nature of the immediate dismissals were likely illegal”.

Broad Effects

Since the director's claimed admission to him, the Department of Justice and the FBI have been dismantled and repurposed for Trump's system of punishment. Six of the FBI's top officials were terminated or forced out in the first days of the presidency. About numerous lawyers at the department have agreed to a “early exit scheme”. At least multiple DoJ lawyers, such as those in the southern district of New York, resigned in protest over what they regarded as political interference in dropping the criminal prosecution against the New York City mayor, a political figure, in exchange for his assistance with his Immigration and Customs Enforcement arrests of foreign nationals. The ethics division of DoJ, which manages ethical violations, has been diminished to minimal staff. The rights protection unit has been severely reduced: the majority of its employees has departed. A third of executives at the department have left. The unit enforcing environmental law has experienced the exit of a majority its management.

Incentives and Punishments

In the legal matter, the interim prosecutor for the southern district of New York, the official, quit in dissent against what she labeled as the “exchange”. The border official, the president's “border czar,” showed up as the implementer with the mayor on television to declare: “If he doesn't come through, I'll reappear in New York City.”. Additionally, a former official, formerly the senior DoJ official and a former Trump attorney, who arranged the agreement, was granted an appellate federal judgeship, a possible springboard to the highest court.

Trump's protection for offenses committed while in office, granted by the unprecedented decision of the GOP-led on the judicial body, thus blocking his prosecution over the political violence and preserving his electoral prospects for the 2024 election, is the basis on which he stands to protect his supporters. Under these circumstances, he has been freed to permit corruption. The effect of the supreme court decision permeates his administration and the political party completely. The legal case has escalated. In the words of Richard Nixon's White House counsel he commented about the Watergate
